In Orange County they allow criminals to pay to stay in jails instead of prison! If a judge says it's ok, a criminal can go to somewhere like Seal Beach Jail and pay everyday to stay there instead of prison! So rich people do not have to go to prison?! These jails even advertise and have made millions from this program. Why is this allowed? Why are more people not up in arms about this?

One possibility is that this government is using this money for rehabilitation. I do believe that they need to be punished equally for their crimes regardless of amount of wealth they have. If they so happen to have wealth. They should have to reimburse the jail/prison for the resources used to maintain the inmate.

As you said, the Judge must authorize the usage of this. Say for example you have two different people who both committed a crime. Person A stole a candy bar from your local supermarket (say it was a 1,000 dollar candy bar). Person B shot two United State's senators in their face from point blank. It makes sense if the person who stole the candy bar could go to the jail rather than a government prison, as they only took something rather than shooting someone. In other words, it varies on the intensity of the crime.

If prisoners of any income could have the opportunity to work for a better place to stay, then I would say that's a good idea. However, I don't think the rich should be able to buy luxury, at least, not any more than someone from the ghetto. This whole thing reminds of the situation in war, where the rich use money to get non-dangerous military jobs overseas, get out of the draft via college, or get some non-dangerous National Guard position. Note, hats off to Elvis Presley for going the difficult route - when his fame and money would have got him something easy.
